About these terms

These Terms and Conditions govern the provision of marketing services by Relish Marketing (“we”, “us”) to clients (“you”). By engaging our services, you agree to these terms.

We are a freelance marketing consultancy. Our business address is available on request.

Our services

We provide marketing services including, but not limited to, website design and development, social media management, graphic design, print material production, SEO and content marketing, and ongoing marketing support. The specific services to be provided will be agreed in writing before work begins.

Proposals and agreements

All work is carried out on the basis of a written proposal or statement of work agreed between us. A project begins only once you have confirmed your acceptance of the proposal in writing (which includes email confirmation) and any required deposit has been received.

Any changes to the agreed scope of work must be agreed in writing and may result in additional charges.

Fees and payment

Fees are as set out in the agreed proposal. For project work, we typically require a deposit of 50% before work begins, with the balance due on completion. For monthly retainer services, fees are invoiced at the start of each month and are due within 14 days.

We reserve the right to pause work if invoices are not paid on time. Late payment may incur interest at the statutory rate.

All prices are quoted in GBP and are exclusive of VAT unless otherwise stated.

Your responsibilities

To allow us to carry out our work effectively, you agree to:

• Provide us with accurate and up-to-date information about your business
• Supply any content, images, logos or other materials required in a timely manner
• Review and provide feedback on drafts and work in progress within agreed timescales
• Ensure you have the necessary rights to any materials you provide to us
• Nominate a single point of contact for the project

Intellectual property

On receipt of full payment, ownership of all original creative work we produce specifically for you (such as website designs, logos and written content) transfers to you. Until full payment is received, all intellectual property remains ours.

We retain the right to use completed work in our portfolio and for promotional purposes, unless you ask us not to in writing.

You confirm that any materials you provide to us for use in your project do not infringe the intellectual property rights of any third party. You indemnify us against any claim arising from materials you provide.

Third party services

Some of our services involve third party platforms such as WordPress, Meta, Google, or Canva. We are not responsible for changes to these platforms, their pricing or availability. Costs for third party services such as hosting, domain registration or premium plugins are not included in our fees unless specifically stated.

Confidentiality

We treat all client information as confidential and will not share it with any third party except as necessary to deliver the agreed services or as required by law.

Cancellation

Either party may terminate a monthly retainer arrangement with 30 days written notice. For project work, if you cancel after work has begun, you will be charged for the work completed to date. Deposits are non-refundable once work has begun.

Limitation of liability

We take care to deliver our services to a high standard, but we cannot guarantee specific results from marketing activity such as search rankings, social media reach or lead generation. Our liability to you in connection with any project is limited to the fees paid to us for that project.

We are not liable for any indirect or consequential loss arising from our services or any failure or delay caused by circumstances outside our reasonable control.

Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to these terms

We may update these Terms and Conditions from time to time. The current version will always be available on this page.
